Mediation is a wonderful alternative to litigation.
It is more respectful to both people and less costly
than litigation. Through Mediation you will reach your
goal to be divorced or legally separated. You will attend
mediation sessions with your spouse to discuss financial,
custody, and asset issues in a friendly and respectful
atmosphere. Through these discussions, the mediator
will assist you in preparing all the court documents
necessary to achieve a divorce at a fraction of litigation
prices!
Mediation is a process involving both spouses who voluntarily
come together to work with a neutral mediator. The mediator
does not represent either party, but will describe legal
concepts necessary for the parties to make informative
decisions and helps both spouses find solutions to the
issues of divorce, such as property and debt division,
spousal support, and parenting and support of minor
children.
| Why Mediation? |

In our traditional adversarial system, each spouse
hires a separate attorney to litigate the divorce. There
is a large retainer fee deposited by both parties. The
lawyers then spend time negotiating with each other,
conducting costly depositions, and then additional time
communicating the outcome of the negotiations to their
respective clients. This adversarial approach is expensive
and time-consuming. If the attorneys are not successful
in reaching an agreement, the court then decides the
outcome of your divorce. The parties are no longer in
control as the court takes full control over your future
assets and parental responsibilities.
Mediation does not require a retainer fee. It is a
"pay as you go" process. Both parties must
be voluntary participants in the process since it requires
complete and honest disclosure. Other fees include cost
courts, sheriff fees, and a fee for the legal documents
completed outside of session.
Mediation sessions are held during regular office hours.
Some evenings and weekends are available to those families
that would otherwise not be able to attend during the
work day. Mediation sessions may also be held over the
telephone and through video-conferencing.
