What Is Mediation?

Mediation is a collaborative process in which the divorcing parties agree to resolve their property and custody issues through structured negotiations, rather than court. The parties agree to hire an independent mediator but may also hire their own legal counsel through the process.

The independent mediator’s role is to:

  1. Instruct the parties in appropriate areas of the law
  2. Explain court expectations regarding a fair settlement proposal
  3. Provide access to independent resources such as accountants, financial experts and parenting specialists who may be needed throughout the process.

Mediation Is Non-Binding

Mediation is not arbitration, in which the couples make their arguments and agree to accept the decision of an independent arbitrator. In mediation, you remain in control of the outcome throughout the process. Attorney Wendy Prince will assist you in preparing your financial statements and the Divorce Agreement. After discussion of the issues and upon reaching a negotiated settlement both parties then execute a Divorce Agreement. The parties present the Agreement to a judge for final review and approval. The Divorce Agreement becomes a legally binding judgment only after the judge’s review.
